<\/strong>Aliment \u00f6d\u0259nilm\u0259si il\u0259 ba\u011fl\u0131 m\u0259hk\u0259m\u0259 q\u0259rarlar\u0131n\u0131n say\u0131n\u0131n ild\u0259n-il\u0259 artmas\u0131;<\/p>\n\n\n\n<p>&#8211; Aliment \u00f6d\u0259nilm\u0259si il\u0259 ba\u011fl\u0131 m\u0259hk\u0259m\u0259 q\u0259rarlar\u0131n\u0131 icra ed\u0259c\u0259k \u015f\u0259xsl\u0259rin i\u015fsiz olmas\u0131.<\/p>\n\n\n\n<p><strong>M\u0259hk\u0259m\u0259 q\u0259rarlar\u0131n\u0131n icras\u0131 probleminin h\u0259lli \u00fc\u00e7\u00fcn a\u015fa\u011f\u0131dak\u0131 add\u0131mlar\u0131n at\u0131lmas\u0131 t\u0259klif olunur:<\/strong><\/p>\n\n\n\n<p><strong>1) M\u0259hk\u0259m\u0259 q\u0259rarlar\u0131n\u0131n icras\u0131 \u00fc\u00e7\u00fcn icra qurumunun v\u0259t\u0259nda\u015f c\u0259miyy\u0259ti institutlar\u0131 v\u0259 m\u0259hk\u0259m\u0259 q\u0259rarlar\u0131n\u0131n t\u0259r\u0259fl\u0259ri il\u0259 m\u00fct\u0259madi i\u015fl\u0259m\u0259sin\u0259 ehtiyac var.<\/strong> M\u00f6vcud probleml\u0259rin m\u00fc\u0259yy\u0259nl\u0259\u015fdirilm\u0259si, probleml\u0259rin d\u00f6vl\u0259t qurumuna \u00e7atd\u0131r\u0131lmas\u0131 v\u0259 ictimai n\u0259zar\u0259tin t\u0259mini \u00fc\u00e7\u00fcn bel\u0259 m\u00fczakir\u0259l\u0259rin ke\u00e7irilm\u0259si vacibdir;<\/p>\n\n\n\n<p><strong>2) Yeni <\/strong><strong>\u201c\u0130cra M\u0259c\u0259ll\u0259si\u201d layih\u0259sinin t\u0259kmil\u0259\u015fdiril\u0259r\u0259k q\u0259bul edilm\u0259si v\u0259 q\u0131sa zamanda icras\u0131n\u0131n t\u0259min edilm\u0259si m\u00fcsb\u0259t olard\u0131.<\/strong> \u00c7ox m\u00fch\u00fcm yenilikl\u0259ri \u00f6z\u00fcnd\u0259 \u0259ks etdir\u0259n yeni \u201c\u0130cra M\u0259c\u0259ll\u0259si\u201dnin ictimai m\u00fczakir\u0259sinin ke\u00e7irilm\u0259si v\u0259 q\u0259bulu tezl\u0259\u015fdirilm\u0259lidir.&nbsp; Yeni \u201c\u0130cra M\u0259c\u0259ll\u0259si\u201dnin ictimai m\u00fczakir\u0259d\u0259n sonra q\u0259bul edilm\u0259si il\u0259 m\u0259hk\u0259m\u0259 q\u0259rarlar\u0131n\u0131n icras\u0131nda m\u00fcsb\u0259t d\u0259yi\u015fiklik olaca\u011f\u0131 g\u00f6zl\u0259nilir;<\/p>\n\n\n\n<p><strong>3) \u00d6z\u0259l icra qurumlar\u0131n\u0131n yarad\u0131lmas\u0131 tezl\u0259\u015fdirilm\u0259lidir.<\/strong> \u00d6z\u0259l icra qurumlar\u0131n\u0131n f\u0259aliyy\u0259ti beyn\u0259lxalq t\u0259cr\u00fcb\u0259d\u0259 m\u00fcsb\u0259t n\u0259tic\u0259 verib. \u00d6z\u0259l icra qurumlar\u0131n\u0131n f\u0259aliyy\u0259ti h\u0259m m\u0259hk\u0259m\u0259 icra\u00e7\u0131lar\u0131n\u0131n \u00fcz\u0259rin\u0259 d\u00fc\u015f\u0259n i\u015f y\u00fck\u00fcn\u00fc azaldar, h\u0259m d\u0259 bu sah\u0259d\u0259ki korrupsiya riskini azalda bil\u0259r;<\/p>\n\n\n\n<p><strong>4) Axtar\u0131\u015fda olan borclular\u0131n \u00f6lk\u0259 h\u00fcdudlar\u0131ndan k\u0259nara \u00e7\u0131xmamas\u0131 \u00fc\u00e7\u00fcn n\u0259zar\u0259t t\u0259dbirl\u0259ri g\u00fccl\u0259ndirilm\u0259lidir.<\/strong> 2016-c\u0131 il\u0259d\u0259k s\u0259rh\u0259dke\u00e7m\u0259 zaman\u0131&nbsp; v\u0259t\u0259nda\u015f\u0131n F\u0130N (F\u0259rdi identifikasiya n\u00f6mr\u0259si) m\u0259lumatlar\u0131 yoxlan\u0131lmad\u0131\u011f\u0131 \u00fc\u00e7\u00fcn borclu ad v\u0259 soyad\u0131n\u0131 d\u0259yi\u015f\u0259r\u0259k \u00f6lk\u0259d\u0259n \u00e7\u0131xa bilirdi. 2017-ci ild\u0259n sonra art\u0131q s\u0259rh\u0259dke\u00e7m\u0259d\u0259 F\u0130N m\u0259lumatlar\u0131 yoxlan\u0131ld\u0131\u011f\u0131ndan bu hallar qism\u0259n aradan qald\u0131r\u0131l\u0131b. Amma bu istiqam\u0259td\u0259 n\u0259zar\u0259t t\u0259dbirl\u0259rinin g\u00fccl\u0259ndirilm\u0259sin\u0259 ehtiyac var;<\/p>\n\n\n\n<p><strong>5) M\u0259hk\u0259m\u0259 m\u00fclki m\u0259s\u0259l\u0259l\u0259rl\u0259 ba\u011fl\u0131 q\u0259rar q\u0259bul ed\u0259rk\u0259n t\u0259r\u0259fl\u0259rin m\u00f6vcud durumlar\u0131 ara\u015fd\u0131r\u0131lmal\u0131 v\u0259 icras\u0131 m\u00fcmk\u00fcn olan q\u0259rarlar verilm\u0259lidir.<\/strong><strong> <\/strong>T\u0259cr\u00fcb\u0259 g\u00f6st\u0259rir ki, b\u0259zi m\u0259hk\u0259m\u0259 q\u0259rarlar\u0131 q\u0259bul edil\u0259rk\u0259n t\u0259r\u0259fl\u0259rin v\u0259ziyy\u0259ti n\u0259z\u0259r\u0259 al\u0131nm\u0131r. Bu da sonradan m\u0259hk\u0259m\u0259 q\u0259rarlar\u0131n\u0131n icras\u0131nda problem yarad\u0131r;<\/p>\n\n\n\n<p><strong>6) \u0130cra m\u0259murlar\u0131n\u0131n \u00fcz\u0259rin\u0259 d\u00fc\u015f\u0259n faktiki i\u015f y\u00fck\u00fc bir n\u0259f\u0259rin icra ed\u0259 bil\u0259c\u0259yi normal i\u015f y\u00fck\u00fcn\u0259 uy\u011funla\u015fd\u0131r\u0131lmal\u0131d\u0131r.<\/strong> Bel\u0259 ki, haz\u0131rda is\u0259 bir icra m\u0259murunun faktiki i\u015f y\u00fck\u00fc r\u0259smi i\u015f y\u00fck\u00fcnd\u0259n 2 d\u0259f\u0259y\u0259d\u0259k \u00e7oxdur. R\u0259smi m\u0259lumata g\u00f6r\u0259, bir icra m\u0259murunun icraat\u0131nda t\u0259xmin\u0259n 1500 i\u015f var. \u018fks\u0259r icra m\u0259murlar\u0131 qeyd edirl\u0259r ki, icraatlar\u0131nda t\u0259xmin\u0259n 3000 i\u015f var. Bu is\u0259 o dem\u0259kdir ki, h\u0259ddind\u0259n art\u0131q y\u00fckl\u00fc olan icra m\u0259muru normadan art\u0131q i\u015f y\u00fck\u00fcn\u00fc keyfiyy\u0259tli icra ed\u0259 bilm\u0259z;<\/p>\n\n\n\n<p><strong>7) M\u0259hk\u0259m\u0259 q\u0259rarlar\u0131n\u0131n\u0131n icra\u00e7\u0131lar\u0131n\u0131n maddi t\u0259minat\u0131 yax\u015f\u0131la\u015fd\u0131r\u0131lmas\u0131 \u00fc\u00e7\u00fcn add\u0131mlar at\u0131lmal\u0131d\u0131r<\/strong>. M\u0259hk\u0259m\u0259 icra\u00e7\u0131lar\u0131n\u0131n faktiki i\u015f y\u00fck\u00fc il\u0259 ald\u0131\u011f\u0131 \u0259m\u0259k haqq\u0131 aras\u0131nda uy\u011funsuzluq var. M\u0259hk\u0259m\u0259 icra\u00e7\u0131lar\u0131n\u0131n \u0259m\u0259k haqq\u0131 art\u0131r\u0131lmal\u0131d\u0131r ki, bu sah\u0259d\u0259 r\u00fc\u015fv\u0259t v\u0259 korrupsiya riski azals\u0131n;<\/p>\n\n\n\n<p><strong>8) M\u0259hk\u0259m\u0259 q\u0259rar\u0131n\u0131 icra etm\u0259kd\u0259n bil\u0259r\u0259kd\u0259n boyun qa\u00e7\u0131ran \u015f\u0259xsl\u0259r\u0259 qar\u015f\u0131 c\u0259za t\u0259dbirl\u0259ri s\u0259rtl\u0259\u015fdirilm\u0259lidir.<\/strong><strong> <\/strong>Bir \u00e7ox hallarda borclu \u015f\u0259xsl\u0259r bil\u0259r\u0259kd\u0259n m\u0259hk\u0259m\u0259 q\u0259rar\u0131n\u0131 icra etmir, yaxud el\u0259 v\u0259ziyy\u0259t yarad\u0131r ki, imkans\u0131z v\u0259ziyy\u0259td\u0259 g\u00f6r\u00fcn\u00fcr. Bel\u0259 \u015f\u0259xsl\u0259r\u0259 qar\u015f\u0131 c\u0259za t\u0259dbirl\u0259rinin s\u0259rtl\u0259\u015fdirilm\u0259sin\u0259 ehtiyac var;<\/p>\n\n\n\n<p><strong>9) \u0130\u015f yeri, maddi imkan\u0131 olmayan borclu \u015f\u0259xs\u0259 qar\u015f\u0131 m\u0259suliyy\u0259t t\u0259dbirl\u0259rinin t\u0259tbiqi zaman\u0131 borcun \u00f6d\u0259nilm\u0259sinin m\u00fcmk\u00fcnl\u00fcy\u00fc n\u0259z\u0259r\u0259 al\u0131nmal\u0131d\u0131r<\/strong>. V\u0259t\u0259nda\u015f\u0131 i\u015fl\u0259 t\u0259min etm\u0259k d\u00f6vl\u0259tin pozitiv \u00f6hd\u0259likl\u0259ri s\u0131ras\u0131ndad\u0131r. \u015e\u0259xs\u0259 qar\u015f\u0131 bu m\u0259suliyy\u0259t t\u0259dbirl\u0259ri o halda t\u0259tbiq olunmal\u0131d\u0131r ki, h\u0259min \u015f\u0259xs q\u0259rar\u0131 bil\u0259r\u0259kd\u0259n icra etmir. \u018fg\u0259r \u015f\u0259xsin maddi imkan\u0131 yoxdursa, onun h\u0259bsi he\u00e7 n\u0259yi d\u0259yi\u015fm\u0259y\u0259c\u0259k;<\/p>\n\n\n\n<p><strong>10) M\u0259hk\u0259m\u0259 q\u0259rarlar\u0131n\u0131n icras\u0131 \u00fc\u00e7\u00fcn alimentin t\u0259yini m\u0259rh\u0259l\u0259sind\u0259 m\u0259hk\u0259m\u0259nin bir qiym\u0259tl\u0259ndirm\u0259 h\u0259yata ke\u00e7irm\u0259si m\u00fcsb\u0259t olard\u0131. \u0130st\u0259r sabit, ist\u0259rs\u0259 d\u0259 g\u0259lirin m\u00fc\u0259yy\u0259n hiss\u0259sind\u0259n aliment tutulmas\u0131 il\u0259 ba\u011fl\u0131 &nbsp;m\u0259hk\u0259m\u0259 q\u0259rar\u0131 veril\u0259rk\u0259n aliment ver\u0259c\u0259k \u015f\u0259xsin \u0259mlak v\u0259ziyy\u0259ti v\u0259 \u00f6d\u0259m\u0259 qabiliyy\u0259ti qiym\u0259tl\u0259ndirm\u0259lidir.<\/strong> U\u015faqla \u00fcnsiyy\u0259tl\u0259 ba\u011fl\u0131 m\u00fcbahis\u0259 yarand\u0131\u011f\u0131 zaman m\u0259hk\u0259m\u0259 \u0259lav\u0259&nbsp; ara\u015fd\u0131rma t\u0259yin etdiyi kimi, aliment ver\u0259c\u0259k \u015f\u0259xsin \u0259mlak v\u0259ziyy\u0259tini d\u0259 qiym\u0259tl\u0259ndir\u0259 bil\u0259r. Bu qanunla m\u0259hk\u0259m\u0259nin \u00fcz\u0259rin\u0259 v\u0259zif\u0259 kimi qoyularsa, aliment \u00f6d\u0259nilm\u0259si il\u0259 ba\u011fl\u0131 q\u0259rarlar\u0131n icras\u0131n\u0131 asanla\u015fd\u0131rar;<\/p>\n\n\n\n<p><strong>11) Aliment \u00f6d\u0259m\u0259y\u0259n \u015f\u0259xsin \u0259mlak v\u0259ziyy\u0259ti, i\u015fsizliyi varsa, yaxud \u00f6z\u00fc q\u0259sd\u0259n bel\u0259 v\u0259ziyy\u0259t yarad\u0131rsa, bu halda da aliment \u00f6d\u0259nilm\u0259sinin babaya v\u0259 n\u0259n\u0259y\u0259 y\u00f6nl\u0259ndirilm\u0259sin\u0259 bax\u0131lmal\u0131d\u0131r.<\/strong><strong> <\/strong>Ail\u0259 M\u0259c\u0259ll\u0259sinin 89-cu madd\u0259sin\u0259 g\u00f6r\u0259, baba v\u0259 n\u0259n\u0259nin n\u0259v\u0259l\u0259rini saxlamaq \u00f6hd\u0259liyi var. Yard\u0131ma ehtiyac\u0131 olan v\u0259 yetkinlik ya\u015f\u0131na \u00e7atmayan n\u0259v\u0259l\u0259r saxlanmaq \u00fc\u00e7\u00fcn \u00f6z valideynl\u0259rind\u0259n maddi yard\u0131m ala bilm\u0259dikd\u0259, buna z\u0259ruri v\u0259sait\u0259 malik baba v\u0259 n\u0259n\u0259d\u0259n m\u0259hk\u0259m\u0259 qaydas\u0131nda aliment almaq h\u00fcququna malikdirl\u0259r. \u018fm\u0259k qabiliyy\u0259ti olmayan v\u0259 yard\u0131ma ehtiyac\u0131 olan yetkinlik ya\u015f\u0131na \u00e7atan n\u0259v\u0259l\u0259r saxlanmaq \u00fc\u00e7\u00fcn valideynl\u0259rind\u0259n, yaxud da \u0259rd\u0259n (arvaddan) maddi yard\u0131m ala bilm\u0259dikd\u0259, onlara da eyni h\u00fcquq verilir.<\/p>\n\n\n\n<p><strong>12) Alimentl\u0259 ba\u011fl\u0131 m\u0259hk\u0259m\u0259 q\u0259rar\u0131n\u0131n icras\u0131nda alimentin naturada \u00f6d\u0259nilm\u0259si v\u0259 ya \u0259v\u0259zl\u0259nm\u0259si m\u0259s\u0259l\u0259si d\u0259 n\u0259z\u0259rd\u0259n ke\u00e7iril\u0259 bil\u0259r.<\/strong> Aliment t\u0259yin olunark\u0259n m\u0259hk\u0259m\u0259l\u0259r \u015f\u0259rtli raz\u0131la\u015fmalar\u0131 n\u0259z\u0259r\u0259 al\u0131r. Haz\u0131rda k\u0259nd t\u0259s\u0259rr\u00fcfat\u0131 sah\u0259sind\u0259 m\u0259\u015f\u011ful olan, yaxud hans\u0131sa formada dig\u0259r sah\u0259l\u0259rd\u0259 m\u0259\u015f\u011ful olan \u015f\u0259xsl\u0259r var v\u0259 alimenti&nbsp; naturada \u00f6d\u0259nilm\u0259si realla\u015farsa, aliment borcunun artmamas\u0131 m\u00fc\u015fahid\u0259 oluna bil\u0259r;<\/p>\n\n\n\n<p><strong>13) Aliment t\u0259yin olunark\u0259n m\u0259hk\u0259m\u0259 n\u0259z\u0259r\u0259 almal\u0131d\u0131r ki, hans\u0131 valideynin maddi imkan\u0131 yax\u015f\u0131d\u0131rsa, u\u015faqlar h\u0259min valideynin yan\u0131nda qals\u0131n.<\/strong> Bu t\u0259tbiq olunarsa, valideynl\u0259r d\u0259 nikah\u0131n pozulmas\u0131 v\u0259 aliment \u00f6d\u0259nilm\u0259si m\u0259s\u0259l\u0259sind\u0259 \u00e7iddi d\u00fc\u015f\u00fcnm\u0259y\u0259 vadar ed\u0259c\u0259k.
